The following Terms and Conditions of sale of products featured in this online store, regulate the agreement between the company INKANDMILK S.L. (hereinafter “Lu Ink” or “us”), with registered office at C/ Madrazo 141, bajos, Barcelona (Spain) -, tax identification No. B-65855256 duly entered in the Mercantile Register of Barcelona, Volume 43330, Sheet 022, Page 425283, and the customer (“Customer” or “you”), which formalized through www.lu-ink.com in order to purchase products from Lu Ink and/or third parties through it.

These terms and conditions apply to any order you place through the website www.lu-ink.com (hereinafter the “Website”). You must read these General Terms and Conditions carefully. By placing an order through the Website, you confirm that you have read, understood and agree to these General Terms and Conditions in their entirety. If you do not agree to these General Terms and Conditions in their entirety, you must not order any product or service through the Website.

ELIGIBILITY TO PURCHASE

To place an order through this website, the customer must have the legal age of majority and be the final customer. Minors are excluded explicitly.

Everyone who intends to purchase products on this website should have the status of “Client”, which is acquired by completing the registration form and accepting these Terms and Conditions and our Privacy Policy.

OFFER COVERAGE

Currently you can make your purchases from Spain (including Balearic Islands; excluding Canary Islands, Ceuta and Melilla), Andorra, and all the countries within the European Union (EU).

It is recommended that the customer keeps a copy of the purchase confirmation as well as the Terms & Conditions when ordering our products.

RIGHT TO CANCEL OR NOT TO ACCEPT AN ORDER

Lu Ink reserves the right to reject any order, cancel or not to accept a confirmed order for the following reasons, amongst others:

  • There was an online store price error when you ordered your purchase.
  • The product is not available.
  • Payment information was inaccurate or unverifiable.
  • Security systems indicate that the request is failed, or might be fraudulent.
  • The customer might be a minor.
  • If after three attempts failed to deliver the order at the address provided.

If an order was canceled by any of the above reasons, Lu Ink will reimburse (if applicable) the value of the order. Shipping charges are never refunded, except in very particular circumstances.

PRICES & TAXES

Prices and any offers that are represented on this website include VAT (Value Added Tax) and, are only valid for orders placed online through the website. The user will always know the price and features of the items prior to their acquisition, seeing them detailed in this website.

Prices are in Euros and include 21% VAT, which applies to all purchases which are delivered to member countries of the European Union.

Please note that products are sold on a DDU (Delivery Duty unpaid) basis. Additional taxes, fees or levies may apply according to local legislation. Recipients of deliveries made outside the European Union may have to pay import duty or formal customs entry. If this is the case, the delivery may be delayed. Lu Ink cannot offer any assistance in these processes. In case of rejection of the order’s shipment for non-payment of these taxes, delivery costs will be deducted from the total purchase return.

Prices which appear in this website are subject to change. Lu Ink reserves the right to change prices without any prior notice. However, after Lu Ink receives an order confirmation, the price payable for such order will remain unchanged.

SECURE PAYMENT

In order to give maximum security to the payment system, Lu Ink uses Secure Payment systems from leading e-commerce financial entities such as Stripe. In this context, any payment confidential data is transmitted directly and encrypted (SSL or “Secure Socket Layer” technology) to Stripe. Visa, MasterCard and American Express cards are accepted through Stripe.

SHIPPING CHARGES

Shipping costs will be shown for your country upon entering your billing and delivery information during checkout. If your country is not listed, please send us an email to see if we can arrange shipping to your country.

DELIVERY

You can receive your order in any address (home, work, etc.), though never a PO Box. But be aware, that the delivery will always be handed over in the same country from which the purchase was made.

The delivery deadline, unless circumstances of force majeure, shall be fifteen (15) calendar days from the date of completion of the campaign. Please note, that even though we usually meet our expectations we cannot guarantee their accuracy. However, when the order leaves the warehouse you’ll receive a notification via e-mail. All deliveries are made Monday through Friday, never on bank holidays. Please indicate a delivery address where the order can be distributed during business hours.

RETURNS POLICY

Cancellation Right
You have the right under the Consumer Protection (Distance Selling) Regulations to cancel your order at any time before delivery of the item(s) or within 7 working days of receipt of the item(s) by following our returns process. You will be refunded the postage charge of your item(s) where the entire order is returned. Please contact our Customer Care Department in order to clarify any questions you may ever have.

Condition of Items for Returns:

  • The product must not have been used, washed or damaged.
  • The product must retain the original label.
  • The product must be returned in original packaging.
  • The product must be complete (two elements forming a pair must be returned together)

Lu Ink reserves the right to refuse or to reduce a refund on any item that is incomplete, damaged, dirtied or not received in reasonable condition.

Other Returns

Other than for defective products, returns outside the timeframe set out above, may be accepted at the sole discretion of Lu Ink and may be refunded as a credit to be spent online. Any unauthorised returns will be refused.

Postage for Returns

We would advise the customer to return unwanted items by recorded delivery or by obtaining a proof of postage from the Post Office or by any other means that shows proof of postage of the returned items. For all Freepost or normal deliveries, it is the customer’s responsibility to ensure that the items are sufficiently insured for claim purposes. This does not affect your statutory rights to return faulty or misdescribed goods.

Lost Returns

Should the Customer´s chosen courier fail to deliver or lose their return parcel, it is the Customer´s responsibility to claim compensation from the courier directly. Lu Ink is not liable for any lost return parcels.

Insurance on Returns

Please note that it is the Customer´s responsibility to choose the most appropriate method for returns with the appropriate insurance. Lu Ink cannot be held responsible for any unforeseen delays e.g. strikes, riots, war or act of God (each an “Event” as defined in “Matters outside our control”).

Matters outside our control

Lu Ink shall not be liable to the customer or in breach of this Agreement for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control (the “Event”). We will contact the customer within a short time of the Event in order to discuss possible alternatives for the performance of the Agreement. If the Event lasts for more than thirty (30) days, the customer’s order will be deemed to be cancelled and the customer will receive a full refund.

Return of faulty product

If the customer returns the product because it is faulty or non-compliance and the return is approved, Lu Ink will refund the product value and shipping costs within thirty (30) days of receiving the garment at Lu Ink’s warehouse. This is without prejudice to the client’s rights as a consumer contained in the existing law of consumer protection.

Providing that all the above requirements have been respected, Lu Ink will reimburse the total amount of the acquired articles. The original postage and handling of the order will not be reimbursed. You will be the one who runs with the postage and handling of the return. If the return could not be accepted due to lack of conformity by the previous conditions Lu Ink will contact you.

In the event that you had received the wrong articles, please contact immediately our Customer Care Department. In such case, and once you have reported the error, the refund will be coordinated from Lu Ink. You will be refunded the postage charge of your item(s) where the entire order is returned.

It is dearly recommended that you send the package to us via registered mail. Packages which do not get to our warehouse will not be refundable.

Once the return has been approved (the items have to be in perfect condition and internal labels must be intact) you will receive a confirmation email indicating that the refund will be paid into your account within 30 days. Remember that payments to your credit card always depend on your bank/building society.

Lu Ink reserves the right to reject returns sent or communicated beyond the return deadlines, or items which are not in the same condition in which they were received.

JURISDICTION AND LANGUAGE

Purchases made through this website and under these conditions of sale are subject to Spanish Law.

Any dispute, disagreement or whatever matter arising from the application or interpretation of these Terms and Conditions of sale and contracts shall be governed by Spanish law and subject to the exclusive jurisdiction of the courts of Barcelona, Spain. All contracts shall be concluded in Spanish.
